A contract is a legally binding document or agreement between multiple parties. An oral contract is an agreement that outlines the terms of a contract through spoken communication. In essence, an oral contract is an affirmed contract. However, the only difference is the way in which the agreement is delivered. An oral contract is a spoken agreement that can be legally binding. Much like a written contract, the parties enter into an agreement to either do or not do some obligation. Despite popular belief, oral contracts are enforceable. They usually are not in your best interests, and end in a "he said, she said" battle. But as long as there is enough evidence, a court will enforce an oral agreement. However, there is one particular exception to this rule, and it's called the Statute of Frauds. Moreover, according to the Statute of Frauds, there are certain contracts that must be in writing in order to be legally binding. This may include contracts for the sale of land or real estate, surety agreements, in which one person guarantees to take over another’s contractual obligations, and service agreements that take over one year to complete.
